Terms and Conditions

1. Services

Elevate 360 provides real estate and commercial media services, including HDR still photography, drone photography and aerial video, Matterport 3D tours, Zillow 360 tours, real estate video, virtual staging, twilight photography, floor plans, and commercial documentation. The specific services, deliverables, price, and schedule for each project are confirmed in writing (by email, text, or invoice) before the shoot. That confirmation, together with these Terms, makes up the agreement between you and Elevate 360.

2. Quotes and Pricing

Prices published on this website are starting rates for residential work and may change without notice. The price confirmed for your booking is the price you pay, unless the scope changes. If the property's actual square footage, size, or requirements differ materially from what was provided when booking, we may adjust the price accordingly and will let you know before or at the time of the shoot. Commercial projects are quoted individually by scope.

3. Travel

There is no travel fee within our standard service area: Summerville, Charleston, North Charleston, Mount Pleasant, Daniel Island, James Island, Johns Island, Goose Creek, Hanahan, and Moncks Corner. Outside that area, the first 20 miles are free and the current mileage rate applies after that. Residential shoots outside the standard area require a $500 minimum project total, including travel. Travel for commercial projects is quoted as part of the project scope.

4. Booking, Rescheduling, and Cancellation

• A booking is confirmed once we have agreed in writing on the services, date, time, and price.
• You may reschedule or cancel at no charge with at least 24 hours' notice before the scheduled shoot time.
• Cancellations or reschedules with less than 24 hours' notice, or a missed appointment, may be subject to a trip fee, which will be stated in your booking confirmation.
• If the property is not ready or not accessible at the scheduled time, we may wait a reasonable amount of time, photograph the property as-is, or reschedule. A trip fee may apply if the shoot must be rescheduled for this reason.
• Weather-dependent services, including drone, aerial video, twilight, and exterior photography, may be rescheduled at no charge if weather or conditions do not allow quality results or safe operation. We will work with you to find the next available time.

5. Property Access and Preparation

You are responsible for ensuring that the property owner and any occupants have authorized the shoot and that we have access to every area to be photographed at the scheduled time. You are also responsible for preparing the property before we arrive. Our Property Preparation Guide is available at /prepare. We photograph the property as we find it and are not responsible for moving furniture, cleaning, or staging. Pets should be secured for the duration of the shoot.

6. Drone Operations

All drone flights are conducted in accordance with Federal Aviation Administration (FAA) rules and applicable laws. Drone services depend on weather, site conditions, airspace restrictions, and any required authorizations. Elevate 360 has final discretion over whether a flight can be conducted safely and legally. If a flight cannot take place, we will reschedule or remove the drone service from your invoice. We do not guarantee that drone services will be available for every property.

7. Payment

Unless otherwise agreed in writing, payment is due upon receipt of your invoice. We may withhold delivery of final media until payment is received in full. Accounts that remain unpaid after 30 days may be subject to collection, and any license to use the media (see Section 9) does not take effect until payment is received in full.

8. Delivery

Edited media is delivered digitally through an online gallery, download link, or hosted tour link. Delivery times are estimates and are not guaranteed. Please download your files promptly after delivery; we do not guarantee indefinite storage of delivered or archived files. Matterport and 360 tours are hosted for the period stated at booking, after which they may be archived or deactivated unless hosting is extended.

9. Copyright and Usage License

Elevate 360 retains full copyright to all photographs, video, tours, and other media we create. Upon payment in full, you receive a non-exclusive, non-transferable license to use the media to market the specific property photographed, including on the MLS, listing websites, social media, print materials, and advertising, for as long as you represent that property.

You may share the media with the property owner and your brokerage for marketing that listing. You may not:

• Sell, sublicense, or transfer the media to any third party
• Provide the media to other agents, builders, architects, designers, stagers, or vendors for their own marketing without our written permission
• Use the media for any purpose unrelated to marketing the photographed property

Third parties who wish to use the media must obtain a separate license from Elevate 360. Commercial projects are licensed according to the terms in the project agreement.

10. Portfolio Use

We may use media we create in our portfolio, on this website, on social media, and in our own marketing. We do not publish the property address or the owner's personal information without permission. If you need us to keep a project confidential, let us know in writing before the shoot.

11. Editing and Virtual Staging

Photos are edited for exposure, color, and composition to present the property accurately. We do not remove or alter permanent features of a property in a way that misrepresents its condition. Virtually staged images are digitally altered. You are responsible for disclosing virtual staging and any other digital alterations as required by your MLS, brokerage, and applicable laws and regulations.

12. Results

Our media is intended to help market your property, but we make no guarantee regarding the sale, sale price, time on market, number of showings, or any other result.

13. Limitation of Liability

To the fullest extent permitted by law, Elevate 360's total liability for any claim arising out of our services or this website is limited to the amount you paid for the services giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages, including lost commissions, lost sales, or lost profits. If we are unable to complete a shoot due to illness, emergency, equipment failure, or circumstances beyond our control, our liability is limited to rescheduling the shoot or refunding amounts paid for services not performed.

14. Indemnification

You agree to indemnify and hold harmless Elevate 360, Holy City Home Photography, and Alex Christman from any claims, damages, or expenses arising from your use of the media in violation of these Terms, any failure to obtain the property owner's or occupants' authorization for the shoot, or any failure to make required disclosures regarding virtual staging or digital alterations.

15. Use of This Website

The content on this website, including text, images, video, logos, and design, belongs to Elevate 360 and may not be copied, reproduced, or used without written permission. We work to keep website information accurate, but pricing, services, and availability may change at any time without notice. This website may contain links to third-party websites; we are not responsible for their content or practices.

16. Privacy

Information you submit through this website is handled according to our Privacy Policy at /privacy-policy.

17. Governing Law

These Terms are governed by the laws of the State of South Carolina. Any dispute arising from these Terms or our services will be resolved in the state or federal courts located in South Carolina.

18. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they were last revised. The version in effect at the time of your booking applies to that booking.
